A plain-English, feature-by-feature review of an actual HDI Global Real Estate Services Errors and Omissions Insurance policy sold to a real estate brokerage, compared against the PBI Group Palomar Professional Lines Real Estate Errors & Omissions Program — so you can read your own declarations page with a sharper eye.

An independent, educational comparison — not affiliated with or endorsed by HDI Global Insurance Company or CRES Insurance Services.

E&O insurance is hard to compare because the differences that decide a claim don't live on the price quote. They live in endorsements, sublimits, and definitions — often on the last pages of the policy. To keep this review honest, we gave HDI its best case: we read an actual issued policy with every coverage endorsement attached — First Dollar Defense, Discrimination Indemnity, Contingent Liability, Pollution — and where HDI's own filed forms are broader than what was issued, we credited the broader filed version. This is HDI at its best documented configuration.

Two differences matter above all the rest. First: whether your legal defense spends down your limit. On the HDI base form, defense costs are inside the limit — every dollar paid to lawyers is a dollar no longer available to settle the claim. HDI can move defense outside the limit by optional endorsement, but it was not on the policy we reviewed — if you're insured with HDI, check your declarations for it. On the Palomar program, defense outside the limit is standard: it is paid from a separate, equally sized pool, so the full limit stays intact for damages. In a serious claim with six-figure defense costs, that single structural choice can be worth more than every other row on this page combined.

Second: who is covered doing what. HDI insures only the services typed onto its declarations schedule, covers bodily injury only for the listing and sale of 1–4 unit homes, and covers an agent's spouse only for liability arising out of the agent's own services — never for the spouse's own acts. The Palomar program defines professional services broadly — down to defined transaction-coordinator administrative work — covers BI/PD for property management at full limits, and insures spouses, domestic partners, personal assistants, and full estates and heirs.

Below, we compare all 37 features. A green cell marks the stronger coverage; where both cells are green, the policies are comparable. Within this feature set no row favored HDI outright — but its genuine extras deserve naming: a $50,000 first-party cyber reimbursement and a $15,000/$30,000 not-for-profit directors reimbursement (HDI-0342) that many E&O forms lack, and the First Dollar Defense endorsement that keeps the retention off defense costs. Several other gaps below can be closed by optional HDI endorsements — defense outside limits, choice of counsel, CFPB, mobile homes — if you know to ask for them. Policy limits, deductibles, retroactive dates, and premium are not compared — those are configured per quote, not features of the form. Select any row for the details and why they matter.

Why it matters: Claimants routinely name an agent's spouse to reach marital assets — and both forms answer that with vicarious-liability protection for the spouse; neither covers a spouse's own acts. Defense costs are INSIDE the limits on the base form — Part 2.B states the insurance “reduces the Limit of Liability… by the amount of Defense Costs” — and that is how the policy we reviewed was issued. HDI can move defense costs outside the limit by optional endorsement; if you hold an HDI policy, check your declarations for it. Credit where due: the issued program includes First Dollar Defense (HDI-0315), so the retention applies to damages only.

Why it matters: The single most important structural difference between any two E&O policies. Defense in a serious real estate claim routinely runs $100,000–$300,000.
