Does your cyber policy defend you when a client's closing funds go missing?

A plain-English, coverage-by-coverage review of an actual Corvus Smart Cyber Insurance™ policy sold to a real estate brokerage, compared against the PBI Group Arch NetSafe® 2.0 program — so you can read your own declarations page with a sharper eye.

Cyber insurance is hard to compare because the differences that decide a claim don't live on the price quote. They live in endorsements, sublimits, and definitions — often on the last pages of the policy. This review is a good example of why that matters, because the Corvus policy we read is a strong one. It is broad on the first-party side, it was broadened further by a wholesale amendatory endorsement, and it beats the Arch program outright on more line items than it loses. If you only counted rows, you might buy it.

For real estate brokerages, escrow and title companies, and property managers, two differences matter above all the rest. First: whose money is covered. Real estate firms hold other people's money — earnest deposits, security deposits, rent rolls, closing funds — and a policy that covers only “your own funds” can deny a trust-account wire fraud entirely. Here, both policies pass that test: Corvus expressly covers Funds Held in Escrow, and Arch covers client funds in your care, custody, and control.

Second: who defends you when a client loses her own money. When a bad actor breaches your network or email, reads Mrs. Smith's closing details, and uses that private information to deceive her into wiring her own funds to a fraudulent account, Mrs. Smith has a claim against you, because a breach of your systems exposed the information that harmed her. We call this 3rd Party Wire Fraud coverage, and it lives in the Network Security & Privacy Liability coverage part. The Corvus policy has that coverage part — and then excludes any claim arising from “the value of… wire transfer.” The carve-back that restores wire coverage applies only to the first-party side of the policy. Mrs. Smith's lawsuit is not defended and not paid.

Both policies are shown at a $1,000,000 aggregate limit with a $2,500 deductible and full prior acts, so the headline numbers are the same and only the fine print differs. Because these two policies were not issued to the same firm, we compare what actually decides claims — coverage structure, sublimits, conditions, and exclusions. The Loss of Funds exclusion removes any Claim, Damages, or Defense Expenses “in any way attributable to… the value of electronic funds, money, securities or wire transfer.” The Loss of Funds Exclusion Carveback endorsement restores coverage only under first-party Insuring Agreement II.E (Social Engineering & Cyber Crime). It does not touch the third-party liability agreement — so a client’s lawsuit over a diverted wire is not defended and not paid.

The Arch endorsement deletes the exclusion for theft of money or securities and for transfer or loss of money from accounts under an Insured’s control — including customer accounts — from the Part A Loss definition. When a breach of your systems exposes a client’s closing details and she is deceived into wiring her own funds to a bad actor, her claim against you is a covered Claim with a duty to defend.

Why it matters: This is the single biggest finding of the review. Picture the most common real estate cyber loss: a hacker reads your email, learns about Mrs. Smith’s closing, and tricks her into wiring her own funds to a fraudulent account. Mrs. Smith didn’t just lose money — she has a claim against you. On the reviewed Corvus policy, that claim is excluded by name: it arises from “the value of… wire transfer,” and the carve-back stops at the first-party side of the policy. Everything else on this page is secondary to this row.

A later-attaching amendatory endorsement — “notwithstanding anything to the contrary” — deletes it and requires notice no later than 60 days after expiration as a condition precedent, with five required elements in the notice.

Why it matters: This is the classic read-the-last-endorsement pattern: the policy gives 90 days on page 41 and takes it back on page 66. Late notice is one of the most common reasons cyber claims are denied, and Corvus makes the deadline a condition precedent.

Three separate endorsements each replace the same paragraph of the Specific Legislation exclusion with different wording, and the Utility Fraud endorsement refers to a limit and retention that are never stated. Which version governs is not clear on the face of the policy.
